PLAINTIFF AFFIRMS UNDER PENALTIES FOR PERJURY THAT THE FOLLOWING ARE TRUE:

1. PLAINTIFF owns a judgment obtained in this Court against the judgment defendant on the _______ day of __________________, _______ in the amount of $____________ together with court costs and interest;
2. PLAINTIFF’S judgment is unsatisfied;
3. PLAINTIFF has no cause to believe that execution against the judgment defendant will satisfy the judgment.
4. PLAINTIFF believes that the judgment defendant has wages, assets, income, profits, or other non-exempt property which can be applied to the satisfaction of said judgment; and
5. That the judgment defendant, ______________________________, has wages, assets, income, profits, or other non-exempt property, due or to which, together with all other property of the judgment defendant, exceeds the amount exempt from execution.

WHERFORE, PLAINTIFF MOVES:

1. That an order be issued requiring the judgment defendant, __________________, to appear in this Court at a designated time and to answer as to any non-exempt property which can be applied to the satisfaction of said judgment; and to answer as to wages, assets, profits, income or other non-exempt property which he/she has, or which from time to time he/she may have, due and owing from garnishee defendant, ____________________________________.
2. That an order be issued requiring garnishee defendant to appear in Court personally or to answer interrogatories under oath concerning wages, assets, income, profits, or other non-exempt property due or to become due, to said judgment defendant and return same to this Court on or before the date set out in said interrogatories; and
3. That the Court after a hearing, issue an appropriate order to apply said property towards the judgment pursuant to statute.
