The Office of Clerk of the Circuit Court is established by the Indiana State Constitution to serve as the record keeper for the constitutionally created Court. The Clerk is elected by the registered voters of Washington County and is limited to serving two consecutive terms. The Clerk of the Circuit Court also serves as the Secretary to the County Election Board which is responsible for conducting all elections in the county including the certification of results.

The Clerk serves as trustee of child support collections ordered by the Court and paid through the Clerk’s Office, and also acts as the chief financial officer of the Courts by collecting, disbursing, and reconciling monies related to court cases. The Clerk collects filing fees, court costs, and judgment monies in civil and small claims cases. In criminal and infraction cases, the Clerk collects fees and fines for city, county, and state jurisdictions, deferral and pretrial diversion fees, bail bond monies, restitution and probation fees ordered by the Court. In Washington County, the Clerk also serves as a Passport Acceptance Agent.

CHILD SUPPORT

MAKING PAYMENTS: The Clerk’s Office does not accept personal checks for the payment of child support. Payments may be made in person or by mail. Payment must be in the form of cash, money order, cashier’s check, or certified check (made payable to Clerk Circuit Court). DO NOT send cash by mail. If you mail your payment and wish a return receipt, enclose a self-addressed-stamped envelope with payment.

INFORMATION NEEDED FOR MAILED PAYMENTS: Please indicate the payor, the name of the person receiving support and the cause number if possible.

PAYMENTS TO CUSTODIAL PARENT: Normally, all support payments are mailed within 24 hours of receipt of payment if the Clerk’s Office has the correct information for payor and recipient. However, on weekends and holidays, if your support payment was received on Friday before 3:00p.m. your check will be mailed the following business day (should be Monday unless a holiday falls on Monday). If your support payment was received on Friday after 3:00 p.m., your check will not be mailed until the following Tuesday. In case of a holiday your payment may be one to two days late in mailing, depending when the holiday falls.

CRITICAL ACCOUNT INFORMATION: Of critical importance to the Washington County Clerk’s Office is information needed to properly receive child support payments and disburse them to the recipient. The Clerk’s Office needs the name, current address, and social security number of the payor and the recipient. Please notify the Clerk’s Office as soon as possible of any address change.

CHILD SUPPORT PAYMENT HISTORIES AVAILABLE: Child support payment histories may be obtained, with proof of identification, (Photo I.D. required). There is a $1.00 fee for each page. Certification is $1.00 extra. Payors and recipients should call the Indiana Child Support Bureau – Kids Line 1-800-840-8757 to verify recent payments, disbursements, and court order information.

ANNUAL DOCKET FEE DUE: Under Indiana Law (IC 33-19-6-5), the payor is required to remit an annual docket fee of $20 to the Clerk before February 1st of each year that the case is open. The Clerk cannot deduct the docket fee from a child support payment.

MARRIAGE LICENSES REQUIREMENTS

Where to Apply: Indiana residents must obtain a license in the county in which at least one of the applicants resides. Out of state residents must obtain a marriage license in the county in which the marriage will be performed. Both must apply in person together.

Fees: If at least one of the applicants is a resident of Washington County, the fee is $18 CASH at the time of application. If both applicants are non-residents, the fee is $60 CASH at the time of application. NO PERSONAL CHECKS WILL BE ACCEPTED.

Identification: Applicants must show proof of identification by a valid driver’s license or an original certified copy of their birth certificate. If these forms are not available a state-issued identification card, baptismal certificate with date of birth, military I.D., passport, life insurance policy with date of birth, school I.D., or transcripts of school records with date of birth may be accepted.

Waiting Period: A marriage license can be issued on the same day of application. There is no legal waiting period to obtain your marriage license. The license is valid for sixty (60) days from date of issuance during which time the marriage must be performed. You may request a certified copy, please allow two (2) weeks. Any additional copies for $1.00.

Age Requirements: Applicants must be 18 or older. Applicants age 17 must have parental consent. Applicants aged 15 and 16 must have a court order and parental consent.

Previous Marriages: If there have been any previous marriages, the application requires information of the month and year marriages ended as well as the manner (e.g., divorce, death, annulment). If you have been divorced for less than 60 days, you must provide a copy of the divorce decree.

All travelers must have their own passport.
Application Form DS-11 may be obtained at the Clerk’s Office.

You will need:

2 Passport pictures
Certified Birth Certificate or Previous passport
Proof of Identification (drivers license)
Processing clerk’s fee $30
Passport fee for age 16 and over: $67, payable to “U.S. Department of State”
Passport fee for applicant under age 16: $52, payable to “U.S. Department of State”
If expedited add additional $60.
If 2-way overnight, add additional $16.25 to Passport fee and additional $16.25 to Clerk.

SMALL CLAIMS

“Fill in the blank” forms are available at the County Clerk’s Office, or by sending a self addressed stamped envelope with your request enclosed.

The filing fee is $73, plus $10 for each additional defendant. Additional $13 if served by sheriff.
The limit to file for an individual is $6,000.00.

For a corporation the limit is $1,500.00.
The claim may be filed in this county if it is where the Defendant lives or where the transaction took place.
We need an original and one copy to serve by certified mail (per defendant) if service by sheriff is requested, we will need original and three (3) copies. If you would like a copy for yourself, make an additional copy.
You will need one copy of exhibits to attach to the original Statement of Claim, plus an extra copy for each defendant to be served.
You must have an address to serve a defendant.

TRAFFIC COURT DIVISION

The Washington County Clerk’s Office is responsible for receipting in the payments for the Traffic Violations Bureau or cases resolved in Criminal Court. When a ticket is issued by a police agency, the following steps are involved:
You have approximately 30 days from the day you receive the ticket to admit (pay) or deny the violation without penalty.
The payment is due on your appearance date. Failure to pay or deny the ticket by that date will result in a default judgment against you and suspension of your driver’s license; and/or issue a warrant for your arrest. The court may also assess an additional late payment fee of $25.00.
ADMISSION: You may admit the violation by signing back of ticket and submit with payment.
Payments may be made by cashier’s check or money order payable to WASHINGTON COUNTY CLERK, (NO PERSONAL CHECKS).
IF YOU CHOOSE TO DENY the violation, you must contact the clerk’s office on or before appearance date. THE APPEARANCE DATE IS NOT A TRIAL DATE.

Traffic Pretrial Diversion Program is handled by the Prosecutor’s office. You must contact Prosecutor’s for this program, 812-883-6560.

VOTER REGISTRATION

The Clerk’s office is in charge of maintaining the record of registered voters in Washington County. Voters may register to vote or pick up the mail in forms at any of the following locations:
